How much does a probate lawyer cost in California?

In California, Probate lawyers have a statutory probate fee outlined in Probate Code 10810 as a tiered structure based on the gross value of the estate and is as follows:

4% For the first $100,000

3% For the next $100,000

2% For the following $800,000

1% For the next $9 million

Who Pays The Probate Attorney Fees in California?

Probate attorney fees are typically paid from the estate's assets. The personal representative (executor or administrator) of the estate is responsible for managing the estate and ensuring that the attorney fees, along with any other costs and debts, are paid before distributing the remaining assets to the beneficiaries.
